1. Product Specifications & Tolerances
1.1. Natural Material: Timber is a natural product; variations in colour, grain, and knots are inherent and do not constitute defects.
1.2. Manufacturing Tolerance: All dimensions carry a manufacturing tolerance of +/- 1-2mm/m at the time of machining.
1.3. Natural Movement: Ezewood is not liable for dimensional changes (shrinkage/expansion) occurring due to environmental moisture after the product leaves our facility.
1.4. Compliance: Products are manufactured in accordance with relevant South African National Standards, including SANS 1783 (Softwood), SANS 10043 (Decking), and SANS 10082 (Timber Frame Building).
2. Payment Terms & Custom Orders
2.1. Standard Stock: A 50% deposit is required to confirm orders, with the balance due prior to collection or delivery.
2.2. Custom & Bespoke Items: For products manufactured or cut to customer-specific requirements, 100% payment is required in full before production commences. Once production begins, these orders are non-refundable.
2.3. Unallocated Deposits: Funds deposited without a valid invoice reference will be held as the property of the Customer in accordance with Section 65 of the CPA.
2.4. No Interest Payable: These funds are held for administrative convenience only and do not accrue interest for the benefit of the Customer. Ezewood is not a financial institution.
2.5. Ownership: Title of all goods remains with Ezewood until the invoice is paid in full.
3. Collections, Storage & Risk
3.1. Collection Period: Customers must collect orders within 5 business days of notification.
3.2. Storage Fees: Failure to collect within this period will result in a daily storage fee of R100/m3.
3.3. Transfer of Risk: Risk of damage or loss passes to the Customer upon collection or delivery to the Customer’s appointed agent.
3.4. Abandoned Goods: Goods not collected within 60 days may be resold to recover costs, following a 10-day final written notice.
4. Returns & Cancellations
4.1. Custom Orders: Custom-machined goods are non-returnable once production has commenced.
4.2. Standard Stock: Returns of standard items are accepted within 10 business days, subject to a 10% handling fee.
4.3. Defective Goods: Material defects must be reported within 48 hours of receipt and prior to installation or alteration.
5. Limitation of Liability
5.1. Direct Remedy: Liability is limited to the repair/replacement of defective timber or a refund of the purchase price of said timber.
5.2. No Consequential Loss: Ezewood is not liable for indirect losses, including loss of profit, site standing time, or third-party penalties.
5.3. Warranty Voidance: Warranties are void if the provided Timber Care Guide is not followed or if timber is incorrectly stored.
6. Legal Jurisdiction
6.1. This agreement is governed by the laws of the Republic of South Africa.
6.2. The Customer is liable for all legal costs on an attorney and own-client scale in the event of legal action for non-payment.
